Criminal prosecution or not, you are not going to get a cent from that. But civilly you may have a case. It really depends your local tort law. There is a saying that every dog will get a free bite. This means that if the dog owner is not aware or should not have been aware of the vivious propensity of the dog and the state you reside has such one free bite law, you are mostly out of luck for strict liability. The rationale is that dog is considered domestic animal and will get such treatment until he proves otherwise. However, you may still recover if the owner is negligent in handling his dog. But you need to check with a laywer to see what options you will have
