請教各位大蝦們 後麵乘客 安全帶發單的問題

我在加州

今天拿到一張罰單，我是後麵的乘客，但是沒有係安全帶而拿到罰單

罰單上麵的code and violation 寫 27315(e)vc

V.C. Section 27315 - Mandatory Seat Belt Law

(e) A person 16 years of age or over ( )2 shall not be a passenger in a motor vehicle on a highway unless that person is properly restrained by a safety belt. This subdivision does not apply to a passenger in a sleeper berth, as defined in subdivision ( )5 (x) of Section 1201 of Title 13 of the California Code of Regulations.

這一條上麵寫著是highway, 但是我們當時是在一條 speed limit 35mph 的街道行駛。

可以上庭嗎？有希望可以打贏嗎？

我不是怕罰錢，但是保險公司會記point.
