If you didn't file your tax return in April and you also didn't file an extension, but you realize, now, that you deserve a refund, are you out of luck? No. You can still file and get your refund.

If you don't file your return by the due date, you generally can claim a refund by filing your return within two years from the time the taxes were paid. But when is the tax considered paid, if you did not turn in a return? When your federal income taxes were withheld from wages and, when you made your estimated income tax payments, if any, your taxes are considered paid on April 15th

But don't put off filing any longer. Your return must be received by the Internal Revenue Service within the 3-year period in order for you to get your refund!

Of course, as you might expect, there's a hitch if you file your return late, even if you're getting a refund. If the return you file late is later changed (for example, by the IRS through an audit, or for some other reason), and it shows that you actually owe tax, you can be assessed a penalty for failure to file your return on time. The penalty is usually 5% of the taxes owed for each month or part of a month that the return is late, and it caps at 25% of the taxes owed (pretty good incentive to get next year's return in on time).
