If you download the picture from the web, you migh have a copyright infringement issue if the photo comes with a copyright notice.

If I were you, I would just go to the store and take the picture. You would not have copyright issue if you use your own photo. However, depending on how you use this picture, you might run into trademark infringment issue.

Consult with an intelleutual property attorney specilizing in copyright and trademark. In you case, copyright is not a big deal, trademark might actually to be a bigger problem depending on how you use the photo.
