It's not "should" or "should not". Your $10,000 has nothing to do with your child's passport. He is a jerk and you are not much better.
If you love your child, you shouldn't put your child in the middle of your fight.
Basically holding your child's passport means taking away your child's travel right. You are hurting your child.
How old is your child? If you hold your child's passport to avoid he takes child away from you, file to the family court to avoid him to do that. Then deal with your ex about your $10,000.
