If you are in California, and the van was already in the intersection before the police car hit it, I don't think the van is at fault. According to the CA driver's handbook, in this situation, the van should pass the intersection before stopping at the curb side.

IMO, you need to talk to a lawyer. I think you might have a chance to get compensation from the police department instead of the on-duty police officer.
