In Canada, common law is treated as legal marriage after 3 years of the relationship. The only difference is you don't need to "officially break and finish" the relationship as we do for marriage (divorce).
For now, you can not do anything about your BF's marriage, but you can do something to protect your child and yourself.
You should get a lawyer to file child support if you have a child together. If the child's father is in Canada or States, he would go to jail if he fails to pay the child support.
Because you filed "common law" in 2006, you could even file spousal support if you don' have a job now.
