請教單身老貓等個位大俠: 買方遇到大問題, 請幫忙.

我們買房遇到這樣的問題, 請大家出出注意:
房價談好了, 房檢做了, 貸款也找好了, 就等著close 了. 現在 appraisal 公司的報告上給出的房子麵子是3095 square feet.並且在賣方要求下, 又從新量過.還是這麽多. 可是從我們第一次看房,整個過程中,我們被房主告知的麵積就是3428 square feet. 這下就少了超過 300squre feet. 10% 的麵積就這麽沒了.

賣家不願意補給我們差價,好象也不願意退回我們的earnest money $7500.
我們準備他們要是還不願意商談的話就告他們, 去法庭尋求幫助.現在我的問題是:

1. 對方說麵積是county記錄的, county 搞錯了, 不是他們的錯. 可也不是我們的錯啊, 憑什麽要我們受到這個懲罰? 還有他們買房的時候應該也有appraisal report.那上麵應該有實際麵積的,那麽他們是不是就存在惡意欺詐?

2. 在這樣false information 情況下, 我們的買房合同是不是就不能成立? 我們不close 房的話, 是否能要回我們的earnest money?

第一次買方, 本來很高興準備要搬家了, 卻遇到這樣的事, 很惱火啊, 請各位出出注意吧. 非常感謝.
