update 回複：谘詢：買房終止合約，如何拿回定金？

Thanks for the suggestions and help. I have posted it to living forum as well. Just some update and clarification here: 我們簽了一個據說是我們州標準的合約，上麵沒有說contigent on the inspection result. 關於home inspection contingency是這麽說的

If the seller is unwilling or unable to repair the major defect to the buyer's reasonable satisfaction, then the buyer has right to terminate the contract.

所以我們agent說要是我們不給他們機會去修，那我們的定金一定拿不回來。我們還想說他們沒有disclose mold problem, and a water damage last year. 這個water damage是我們打電話給保險公司無意發現的。我們的agent said we have to prove that they did know of the mold. 因為這個mold雖然是在車庫，visible,但是化驗分析是幾個月之前長的，而他們離開這個州已經一年了，所以如果我們到法官那裏去，不一定能贏。那我們就想說回複一個苛刻一點response,讓他們給我們一個10 year warranty. 我們agent又說這個不reasonable, 他們如果不同意的話，我們還是要到法官那去，還是不一定誰贏。而且他們可以反告我們耽誤他們的別的buyers. 我們給一些real estate attorney打了電話，雖然他們說法不一，但是共同的一點就是不建議上庭，因為費用昂貴，遠超過我們這幾千定金

所以現在舉旗不定，還望有經驗的過來人不吝賜教，謝謝
