My wife is a PA in general surgery dept in respected hospital in the states, she does minor surgery like yours on daily bases. I am a long time Len Tillem (bay area legal talk show host) show listener. I think I can answer some of your concerns.

all the surgeries has risks, it's hospital's responsibity to list all the possible complications/risks. sometimes it will scare the sh*t of you just by reading them, but some procedure like yours are merely routine , nothing to worry about. As for Hemorrhoids, you know the surgery is not cure-all. good habit will do the same trick. warm-water bath (sit on it), drinking lots of water, heavy on fiber (veggie), max. 2 minutes when you do your thing. bowel movement daily. only go to bathroom when you have to. familiar with that? did your doctor telll you all of these?

As for liability goes, it's too early to talk about that. if the worst comes, talk to medical mal-practice lawyer first and see if he will take your case. the criteria is: 1) any thing obvious wrong with procedure? can he get experts in that area ($400-$600 an hour?) to testify that the doc did something out of textbook? 2) how many money does it involved? most likely these cases are contingency based, the lawyer will get a cut based on the final award. If the amount is small or there is no chance to win, why does he take it? right steps but bad result doesn't count. Practice normal in China but not here do not count, neither. unless the doctor didn't do what he/she trained to do, he/she is not liable.

in your case, unless the doc worked on your front other than back, or did something out of ordinary that makes you paralyze, I didn't see any legal ground that you can file the law suit.
