an official cancellation (paperwork saying the seller keeping the earnest money and the deal is off), the seller should return him earnest money. Otherwise, he is selling his house to two different parties, which is certainly not possible. Talk to your realtor, or lawyer. I would think the seller will return your earnest money as he wants the new deal goes through without extra hassle.
