I dont know where you are, in NV HOA can only raise the fee 25% per year. The President has no direct involvement regarding the fee. He can not get hands on the case. He has to go through the board members especially the treasure to get the approval and management company (3rd party) issue the check. There is a check balance.
Large fee increase or spending require 51% or more members to vote off. If only 30% member showed up, then there will be an increase.
I guess your state has less regulation on the HOA than NV here. HOA also subject to state gov and independent audit per year so there will be very little space for them to steal. Yes criminal complain can be filed against president and board members.
If I were you I will check the CC&R for how to eliminate the president and call for a board emergency meeting. Then contact the authority regarding his act. If he is smart, he will get out of town. If he is not he can serve jail time.
