My hu*****and is J-1 holder and works in a Gov. institute. He works hard and his boss promoted him and sponsored H-1. We have submitted the waiver application in March, but have not received waiver. We have a happy live before two days ago. Now nightmare begins. Two days ago, 網管 found my hu*****and downloaded some music, movie and software using his working computer. The terrible thing is some software they think is 黑客 software, then suppose my hu*****and has software terrorist 傾向.. It is ridiculous; my hu*****and works in the cell-biology field. He spends lots of time in the experiments. You know, what the lab job is. The director asked my hu*****and to resign immediately and will not have any record. If not, he will have some lawsuit. My hu*****and's boss told us he tried his best to argue with the director and let my hu*****and to resign in 6 weeks, but the resign letter must be written now. So my hu*****and wrote the resign letter yesterday. That means we have to leave in 6 weeks. More information about the IAP-66: My hu*****and extended the last 2 years (4th and 5th year J-1) last July. And his IAP-66 will expire next July. Questions:
1. Is it illegal for all of us staying here after this July?
2. Is it possible for us still to get the waiver?
3. I am J-2 holder and work in a non-profit Asso. My EAC will expire Next July. Now my hu*****and resigns this July, does that mean my EAC expired automatically also? Is it illegal to work after this July? Frankly, my boss has little knowledge on the status. If I do not mention it, she will not know.
4. How about this suggestion I continue to work and my hu*****and still stays here to look for a job? After we get waiver, I apply H-1. Is it possible?
5. We have two kids; both of them were born here. Can we apply 居留權? If can, how to do?
We know it is my fault first, but we never realize it is so severe. Now we now what is called “it is only one step between heaven and hell”. Do you have any suggestion for this situation? I really appreciate. Thanks in advance.
