Which state are you in? Here is my experience years ago in FL:

I had an accident with a friend on my own drive way. Both of our cars were moving when the crash occurred. I called my insurance company and told the agent that we both were moving and willing to split the responsibility 50-50. Then, the agent told me over the phone that, by Florida's law, the driver who is backing up is 100% responsible no matter whether the other car is moving or not. So, my insurance had to pay for both repairs (>$5000) and I had to switch company to avoid a huge premium hike at the renewal.
