It is 100% stupid to let your own insurance company cover it. You should immediately consult a car accident lawyer and he can help you get lot of money from that drivcer's insurance company. There are lot of such Chinese-English bi-language lawyers. For such cases, if they don't win they don't charge you. Make sure about it first. Usually if they win the case, you get 66% and they get 33%. If it turns out the driver has the fault, you can get paid for injury, labor cost, and most importantly inconvenience fee.

When I had my first car accident, I relied on myself because I thought a lawyer will cost me too much. but it turned out I was silly. Last time I hired a lawyer and I just split the money with him who helped me easily won the case.
