求助：樓上的熱水器壞了，把我的房間淹了

度假回來，發現房間淹的一塌糊塗。原因是樓上的熱水器壞了。但樓上的保險公司說如果不是樓上的房主做錯了什麽，他的保險不會止付我的損失。我的保險公司同意支付我的損失。但我要付250 deductable。請問我可不可以要求樓上的房主支付deductable? 我住在colorado州
