Please help on this complicated matter! stp 單身老貓 and other exper

On May 19, a quiet rainy day, our car was in the parking lot, got involved in a chain car accident, basically the hitter hit 5 cars in chain, the second car next to us was a total loss (impact was from our car directly, just imagine the impact!). Our car was turned 90 degree on spot, then the police report, claim, appraisal, and repair followed...

The hitter’s insurance was reluctant to pay for all the repair, (because more problems found after the initial appraisal), after we argued numerous times, they still don’t want to pay all the rental now.

A detailed time line is: the accident was on May 19, it was not drivable on appraisal, we didn't rent a car until the garage took our car for repair at May 29, and no car for 10 days on front (lots of walking, public transportation with a new baby just joined us during that time period, going to doctors, lactation consultant, shopping, ... were very inconvenient!) we got our car from garage on 7/20 and found out the gas gauge was not fixed. We took the car back to dealer ship on 7/30 since the body shop can not fix this. It took them 2 weeks to approve the repair, I got my car back on 8/10.

So, in conclusion, our car was not drivable for 74 days (except from 7/20 to 7/30 we were driving while the gas meter showing zero gas in the tank) and we only rented for 59 days.from 5/29 to 7/20.

The insurance paid all the rental at first, then we found that our credit card is charged since they took away some, they said that the garage should be responsible for the week of July 4th, they claimed that the garage should speed the repair before they close for holiday.

Who should we hold responsible for this? I think it should be the insurance company, because as the garage said that they just took a 4 days vacation, everybody could do it.



Any suggestion is highly appreciated! Is the small claim court our only options now?
