請問好心人，在美國day care幼兒被同班男孩撞倒，誰負責？

我幼兒（當時17個月大）今年二月去一day care.在第一天morning我給了半月訂金(no agreement signed yet)，然後帶她還有我的大孩子（10 歲）及她的同學去她教室. I left my daughter in the classroom with other toddlers (around 10 to 15 toddles) and one of three teachers came and talked to me and tried to help. Kids were very active then. When I tried to put my daughter's stuff on the cubinet I saw one of the boy run into my daughter at his full speed and my infant daughter fell down on her back of her head. The teacher picked her up. She sobbed and couldn't make crying for a minute. Then she cried loudly. I was appauled and didn't know what to do at that moment. Then I carried her to try to comfort her.
I carried her to the director's office and asked deposit back. They seemed refuse to do so. I was really mad. I called 911 right away. The ambulance also came and brought my daughter to ER room for checkup. Doctor in ER did check her didn't find damage to her at that time. Even through I think it may danage her brain without notice now.
Now the daycare refused to pay all the bills. I sued them at the local court for about $3200 bills. The daycare responsed that allegation denial. The court is set in this month.

Please give me advice if you know. Can I win the case? Now I am chased by collection agent for the bills.
