Please help this question about the deposit for buying a house.
The offer has been accepted and the deposit is helt by title company for removing loan contingency which is the last contingency. Since my re-fi process is delayed and the seller is little pushing the our agent(does both sides). My question is: can I sue the agent to get deposit back if I sign the doc for removing all contingencies and I do not get loan at the end? Because it says I will not get deposit back if I sign the doc even I do not get the laon. The agent said there is only 2& chance I am not going to get final approval, but I want to be 100% sure. So wonder if the agent sends me the doc for me to sign and is he responsible for my deposit?
