Yes and No!
Yes, it is right if the situation falls under the first consequence senario as I previously described for US citizens or aliens with no intent to remain in this country. No, absolutely no, according to #2 consequence in my previous posting! Based on the advise by this school attorney, it proves at least two points: a) free stuff/advise normally is not the best, and b) this free campus lawyer knows nothing about the U.S. immigration regulations and/or consequences but dares to advise. It's amazing! Your friend NEEDS an experienced criminal trial attorney who also handles or understands immigration matters with deportation and/or removal proceedings in particular (not those immigration attorneys who handles only the employment based cases such as H-1Bs or National Interest Waivers, etc. or the family based cases such as I-130s for family members, with all the due respect and because of the potential issues involved in your friend's case)!
