How can you transfer the estate to youself?

In some jurisdictions hu*****and and wife are tenants by the entirety. In most jurisdictions you and your hu*****and are tenants in common. Either way, both of you have possession interest in the entire estate so that unless an alienation action is filed and ordered there is no way you can transfer the entire estate to yourself, unless your hu*****and consents to will or convey the estate to you or you take it by survivorship. One spouse alone cannot convey, encumber, or subject to the satisfaction of creditors’ claims either that spouse’s possessory estate for the joint lives of the co-tenants or that spouse’s contingent right of survivorship.

Besides, if VA is a community property state and the house was bought within a marriage then even if you legally get the full estate it is still considered community property in a divorce action.
