不能不付房租

Don't worry about deposit. The owner will give back you within 30 days you moved out, just matter of how much he refunded to you. You still have to pay the rental per contract, otherwise he can sue you for the rent and lawyer fee. You ended up to pay more and have a negative remark on your credit. If the amount of deposit returned to you is not reasonable, you can go to small claim court to sue him and you have chance to get some back if you have a good reason for.
