2) My neighbor did not back onto his driveway. He drove forward into his driveway.
Over the last couple of days, I had plenty of time to analyze the corner of our street. I've got what I think is good evidence that if he indeed just finished pulling out of his garage, as he claimed, it is impossible for his car to be behind me. Further more, if he was indeed pulling out, our car has no chance to collide when he drives forward to avoid me. The damage to my car clearly indicated that the impact started from behind my car to the rear right bumper, supporting my observation that he was headed right into the cul-de-sac, rather than heading out, as he claimed. To my eyes, the damages on both cars also indicate that I did not back into him, but rather, he miscalculated his clearance and hit me when he drove through behind me.
