Under the US law, intoxication by medication is a defense only if it negates the "intent" element of the crime. In this case, the question would be, under the prescribed medication, which is a kind of involuntary intoxiction, did he possess the intent to commit the crime. If he were so heavily medicated that he didn't know what he was doing, then he would not be guilty of larceny. However, from what we heard, it completely doesn't sound like the old man was so dizzy woozy that he took the things unintentionally or by mistake. It was clear that he wanted to steal and not to pay. So in this regard, his medication wouldn't help him at all. This is so despicable and disgusting.
