Don't worry too much. There are pretty standard procedures need to go through in such a case. If he has decided no coming back, it is simpler. I am sure the court will provide a free public defender and a free translator. Talk to the public lawyer regarding the situation and what your family want and do what the lawyer recommend. Such a case will affect the green card application. However for him, it is not an issue.
