From what you show here. The contract does not say if you can not get the loan, what will happen. Only thing here in the condition section is if you can not provide the approval (commitment letter here), the seller may terminate the contract and it does not say seller need to refund earnest money. So the seller ask to hold the earnest money is not violate the contract.

You may check the contract to see it include a non-conditional terminate clause (in Texas, we have option period that for a samll fee, the buyer has right to terminate the comtract in certain days, 7 or 10, without any reason.

Also do you have a Realter or attorney help you when you sign the contract. If your Realtor or attorney does not explain or use the right contract form, you may seek compensation from them.
