Sorry to hear this story. These kinds of things happened each day in some school(even in some good schools). You son will learn to protect himself
gradually. With the improvement of his English and more familar with school enviroment, he will be OK.
I don't think you need to seek legal action(you most likely waste money if you have ever deal with the lawers).
But You do have to talk to school authority.They may reimburse your ER fee. One day suspesion punishment for Black kids may be fair. Each school district has their code(you can check it).
