It is still too early. You need wait untill closing date. If he does not close, he is in breach of contract, upon which you can go to court to ask for specific performance. Assuming you are buying a single family home, not a condo or something, unless there are some difficulties such as the vendor just discovered that he did not have a marketable title or his possession is under the color of title, he MUST sell to you, because he signed the contract.
If the owner expressly and unequivocally told you that he did not want to sell, you may bring the suit now for anticipated repudiation.
