請教單身老貓！！！

我在我租的APARTMENT BUILDING 的 DRIVEWAY 上摔倒，當時LANDLORD正在修理他的DRIVEWAY，有很多CONSTRUCTION FACILITY，但沒有任何CONSTRUCTION 的保護措施，包括SIGN。當時是晚上10多鍾，沒有任何的照明燈。也因為是晚上，我沒有任何WITNESS 因為我是自己住。但當時叫了警察，警察來了，也給我寫了REPORT，說了在CONSTRUCTION DRIVEWAY 上摔倒，DRIVEWAY沒有任何照明燈和其他保護措施。摔倒時鼻子碰到了DRIVEWAY上的CONSTRUCTION MATERIAL，被割了一個口子，我第二天去醫院作了處理，還照了X-RAY，怕有內傷。

請問，這種情況我上廷贏的機會有多大？主要擔心兩個事：
1。我沒有WITNESS
2。在這之前，我和LANDLORD因為一些糾紛上了庭，我輸了。會不會影響這個CASE？LANDLORD 是意大利人，非常MEAN
