you are absoulately fine as long as you don't want to be hired back from the same company.
One guy formerly worked for me is suing our company now. I was not aware of this and was trying to hire him back. Then HR told me this and pretty much they told me the rule is hold the decision before the case is done. He find another company now and the case is still ongoing.

I can't believe why so many Chinese are so chicken-head in this country. No wonder everyone enjoys screwing Chinese because they have no idea how to defend themselves. Poor people.
