You said the accident happened a year ago. Why is the law suit now. I assume the plaintiff has filed the suit for a while and now getting to the trial discovery stage. If so, I suggest you to have the facts and everyone's position understand clearly, so you can analyze how much an exposure you have. That will anwser your first questions.

As to the miscommunication on deposition, you can use the excuse to reschedule a deposition. That is not a big trouble for lawyers. By the way, sounds like you don't have a lawyer representing youself. Whether necessary, it depends on the stake on the table and how much insurance & finance you have for a backup. It depends on a lot of things. Again I suggest you consult with a professional.
