Everything depends on the coming interview. If they decide to issue the visa, then I think everything is fine. But your friend might want to confirm with the VO regarding this.
If they decide to deny the visa application this time, I personally think it makes his/her last visa and entry illegal and the person will be banned from entering US for some time.
You can try to get the court documents showing the case had been dismissed and expunged. They may not give them to anyone but your friend him/herself. But the documents can help to prove or argue that your friend does not know it must be reported on visa application.
