college planner's fraud

I hired a college planner for my son last year for a total of $2000.00, which would have covered 3 years of service.She did not provide any detailed academic plan for my son during this year as she promised. What she did was only to pressure us to buy life insurance and/or annuities so that she could profit from the huge commissions. She even set a deadline to push us to buy a $100,000 annuity contract which was totally unsuitable and unnecessary for our financial situation.We are now unable to access the $100,000 until we reach the age of 59 and a half. That $100,000 was actually to be our son’s college fund and our emergency reserve. We face the huge charge when we need that money to pay for my son’s college.

Now we want to terminate the contract.(we paid $1000 first.) She sued us for another $1000 in small claim court.

Do you think I can counterclaim her misrepresentation and fraud? Any suggestion?
