很複雜的離婚,請教老貓先生,謝謝

曾經有過外遇在離婚前,之後提出離婚,在進入法律程序兩個月後,和外遇斬斷關係,(前後一共6個月).
雖然結婚七年,和丈夫的關係不好,他曾因為打我有個刑事案,但因為不重,被法庭裁決給我半年的保護令.
現正在辦離婚,他有資財,我是學生,兩個都是公民.
1)他起訴我婚姻欺詐,為了保護他的財產,問他可能贏嗎?
2)對方在收集我以前外遇的證據,如果他能拿到人證物證,根據法律,我還能分到財產嗎?
