Yes, your understanding is correct. If you are originally charged as domestic violence misdemeanor, you have to get your case dismissed or be found not guilty. Immigration officers will find you guilty in domestic violence even if your charge is changed or lowered.

You have to find a very good defense trial lawyer with extensive experience in domestic violence. Because you were not arrested on the crime scene, and if you have not admitted that you did beat your wife, a good lawyer will get the job done.

You may get your case dismissed if you can do these two things:

1. Your wife cooperates with you. Your wife does not appear on court. She can NOT be served when your court send her notice (like subpena).

2. If your wife does not go to trial, nobody can identify you because you were not arrested on the crime scene and no cops have seen you.

Based on these, a good defense lawyer will ask DA to drop the case. The reason is simple: nobody can identify you and who knows that it was you who beats your wife up?
