It is not that easy.

You have to talk to her kindly, and ask her to move out. You have to go to housing court not small court.

Don't worry about the lease, in New York, the lease protects tenant more than landlord, without lease, she has to move out.

At the same time, you need a lawyer. The lawyer can send her a demanding payment letter/$100/per letter first. Most time, people would leave before the court day, then you could save the legal fee.
