Most states apply strict liability for animals. For domestic animals, the rule is that unless the owner knows or has reason to the know the dangerous propensity of the animal, he or she is not liable for injury that the animal caused. There is a saying of "every dog gets a free bite", which is closely resembled the rule. If you want to sue, you have to prove that the dog attacked before and the owner knew or has reason to the know the attack. Otherwise, you will lose.
