Based on the limited information, your hu*****and worked as an H1B alien for company A, and formed another company B with a partner. If he did not get the proper H1B for company B he is in violation because H1B is employer specific and he can only work for the petitioning employer. Immigration law prohibits H1B people to work outside scope of the H1B, such as self-employment or work as a contractor outside the petitioning company.
