First let's clear the way of insurance beacuse somebody on this board are always confused between insurance coverage and civil action. If it is insured, then you should gete your money back.
If it is not insured, there are several things you need to consider. First, did Amazon misprint your address or your name? If assuming nothing was incorrect then Amazon is not responsible for the loss. This is based on unifrom commercial code that when the merchant (Amazon) tendered the goods to a carrier the risk of casualty is passed onto the buyer, unless it is expressly agreed that the goods is delivered FOB (free on board) a named destiny. Once Amazon made the agreement to tender the goods to UPC, Amazon is not responsible for it anymore. The only responsible party is UPS and the guy who received the package. You should talk to UPS to retrieve that package. At least ask UPS about the guy's name and address, and his signature so that you can take it to the police. The reason I want you to take it to the police is that if the receiver signed for the package, immediately realized that it was not for him but still decided to keep it, he committed a larceny, which is felony in common law. The police may be able to help you retrieve the package. If you can not retrieve it and UPS refused to pay for it, you can hold both the receiver and UPS liable for conversion.
You are lucky since you used UPS. If it is US postal office, you may not get anything back because of the governmental immunity.
