my wife had a car accident yesterday. fortunately, she was ok. she was going to work and driving through an intersection on yellow light, at about 40mph, and a guy driving a pickup was oncoming and turning left. he should have yielded to my wife since it was still yellow light, but he started too early and they smashed into each other. police and even firetruck came. nobody was injured.
it turned out that guy was illegal immigrant without any id or driver's license. the owner of the pickup came later. and he told the polic he did know the guy was driving his vehicle and that was first time. eventually, the guy was arrested and sent to jail. while this guy had no driver's license, the pickup was insured.
my car was serverly damaged but still movable. but obviously i can't drive a car like that any more.
now my question is: can i sue anybody involved here? if yes, should i sue the guy, the owner, or the insurance company, or all of them? i would think my car would be totaled by the insurance company. how much money could i get back (percent of the car's value)? is this 100% responsibility of the guy or/and the owner? my car is insured liability.
