Here is some answer to your questions:
1. 15K is the real lose. We sold out the house to another buyer, the price is higher than the first buyer, however, the second time was sold by agent, so we paid 16k commission, also due to the delay, we have to pay double mortgage, equity loan for one month etc. (we bought another house before sell our house).
2. We know the buyer was offering my neighbor after sign the contract with us about 7 weeks (still under contract with us), my neighbor said they could witness this for us if it is necessary (they are american). After the buyer knew we know this fact, they did not continue offer my neighbor.
3. I know they locked their rate, but don't know if they really started their loan process, during the one an half month, no appraisal was done.
4. after the second deposit due day (10 days after attoney review settle), they did not pay it, (they even said they sent to their attoney, but their attoney did not receive it, etc.)
5. On the commitment due day, they said they did not get the commitment, when we ask the bank reject letter, they sent one said due to the wife has not enough credit, they could not get the loan (there even no their name on this letter), but they did provide a pre-approval letter before sign the contract.
6. they have $1000 deposit on my attoney trust account, they even did not ask to take it back.
7. Before offering my house, they said they break another contract because they are more like my house (still under attoney review when they broke it)
8. There were a couple of minor issues from the house inspection, our lawyer sent a letter said what we offered, a couple of dollars or fix, they never responsed.
They are lying all the time, for example, the hu*****and called us and my neighbor from a same number, but he told my hu*****and this is his attorney office number, but told my neighbor he is at home !
We are really angry with this buyer, they are not honest people, only think about their own interest, but hurt other's! At the beginning, they beg us to sell the house to them (his wife has a baby due in one month) and stop open house, then they use our house as a backout and continue to look around and offering, and lied to us ... Never see this kind of people before.
I want to sue them, not just for the money, their behavior should be penished. Does the law only protect buyer, not the sellor? if so, why do we need sign the contract?
