Yes you can hire a lawyer to represent you. It is worth a lawsuit but frankly, the result is unpredictable. Based on what you said, there was a "no walk" sign and walked crossed anyway. That is your fault. The driver is not totally off hook either. Raining and darkness are natural conditions which are not in his defense. It depends on whether a reasonably prudent person would do the same thing in the same darkness and rain. You said that you were rendered unconscious. That could imply that either he was over speed limit or he was negligent at turning. The fact that he had the right of road does not mean he was negligent as the traffic code only provides minimal standard of care. Pennsylvania is a modified comparative fault state so that if the jury determines that your fault is more than 51% then you lose. Otherwise you will recover the actual amount. For example, if your fault is 40%, then you recover 60% of the total damage. If you recover, you have to pay back whatever you got from the insurance company.
