you are absolutely right.the exclusive control refers to the injurious instrumentality, the floor in this case. but you may not easily say the floor is TOTALLY under Gap's control, remember a shoe store case, in which the sitting stool provided by the store for customer to try on shoes was said under injured customer's control.
