seek lawer's serivice at this time. According you, the exchange between insurance companies has pretty much laid the fault on other party. So get your necessary treatment, and use your health insurance. His insurance company will cover it, plus other stuff.

If for some reason the other party want to use police report to deny responsibility, then talk to a lawer. Do not mind the lawer fees. They are contigent, meaning they won't get paid if they lose the case. The other insurance most of the time will try to settle out of teh court. 25k is a small amount money we are talking about here.
