Depends on his insurance policy. Most people, cheap ones, only buy liablilty because it is mandatory.
But lialbilty doesnot cover the damage of your OWN car if you are at fault. It covers the other party, up to the policy limit. Other things are also considered, medical bills pain and suffering , loss of wages, etc.
For the newcomer, I net his policy is minimum. If the damage to the other party is more than his policy limit and the other party sues, and court grants it, he is liable. Does not mean he will pay for it? What is his worth since he just got to the states?
If he can not pay, he can not pay.
No jail issue here. Don't scare him. Just pay the fine.
