Of course you can always hire a lawyer. I had a case in which the seller on eBay didn't send what I paid for, I found a lawyer (in another state), and filed a suit. I paid the lawyer, but the judgement I got was more than enough to cover that legal cost (court cost, lawyer's fee). But depending on state, collecting it is totally another matter.

ASSUMING your case is like mine, and you have convincing documentation, hire a lawyer in the same city as the seller. AT LEAST find someone to consult, it usually won't cost anything. In my case, I consulted more than one in my location, they all adviced that I hire someone in the city as the seller. So I did.

Get the lawyer to write a letter of warning (or whatever it is called legally), then go from there.
