you have no proof that he took your phone, so it's your fault for accusing him. however, he is at fault for hitting you. it's just like hitting someone as they are walking across the street. you can sue him for physcial injure (some soft tissue damage are not visible) or psychological damages. any kind of traffic accident lawyer can help you.
