You must figure it out if the attorney has filed your H-1B since the cap has closed last Thursday. If he has not file your H-1B, you might be in big trouble. You then have to wait fill October 1, 2007 to start your H-1B. You might lose your F-1 status if your OPT expires before 10/01/2007.

Your wife can register as F-2 or she can apply for F-1 herself. Ask the school to issue her I-20 then she can file F-1 herself with CIS.
