Don't worry. There quite a few ways of fixing this problem. If you do ask the bank to send you 1099, you only need to file an adjusted tax return for 2004. If the bank never sends you 1099, then it is your choice to file again or not. It is always safe to follow the law, though. I don't think the IRS will audit foreign aliens at all since most of them are not rich.
