Your lawyer did not act ethically. The Rules of Professional Conduct requires that a lawyer honor the client's decision. As for firing the lawyer, as a client, you can terminate the relationship at any time, but getting your money back is a different matter. First, you should look at the contract to see what the fee is about. Is it a retainer fee or something else? Second, it depends on how much work the law firm has performed on your behalf. If it hasn't done much, you have a better argument for getting some of your money back. But in the best case scenario, you still have to pay for all the expenses incurred (FedEx, etc.) and the value of the work performed on your behalf so far. Each state's law may vary somewhat. And finally, you should keep a record of all the correspondence w/ the firm. By the way, reporting him to the state bar is no use. State bar seldom disciplines lawyers and even when it does, it takes forever.
